What You Need to Apply in Weymouth

Both partners must appear together in person. This is a state requirement that applies in Weymouth and everywhere else in Massachusetts. You cannot send one person ahead or file anything by mail. The clerk needs both of you there at the same time to sign the application.

Proof of age is required for each applicant. Massachusetts law under MGL c. 207 § 33A is clear: a driver's license is not acceptable as proof of age for a marriage license application. This is a rule that catches many people off guard. You must bring a birth certificate, a passport, an I-94, or an I-551 (green card). One of those four documents for each of you. Make sure you have them before you make the trip to Middle Street.

You also need your Social Security number. Know the number. The clerk will record it on the application but does not need the physical card. If you or your partner was previously married, come prepared to explain how the prior marriage ended. The clerk will ask. Bring a divorce decree or death certificate if that applies to you. Both applicants must be at least 18 years old. Since 2022, Massachusetts has no minimum-age exceptions under MGL Chapter 207, even with parental consent.

Waiting Period and License Validity

After you file your application at the Weymouth Town Clerk's office, a 3-day wait begins before the license is available and the ceremony can happen. The waiting period starts the day after you apply. It includes Sundays and holidays. File on a Monday, your earliest ceremony date is Thursday. File on a Wednesday, wait until Saturday. Since the office is closed on weekends, you would pick up the license the following Monday if your 3-day window ends over the weekend.

The license is valid for 60 days from the filing date. If your ceremony date shifts past the 60-day window, the license expires. You would have to apply again and pay the $35 fee a second time. Most couples schedule the ceremony within a week or two of getting the license, so expiration is rarely an issue. But it is worth keeping track of if you have a longer lead time between filing and the ceremony.

If you cannot wait 3 days, there is a court process to get a waiver. You apply through the Probate or District Court and pay a fee of around $195 under MGL c. 207 § 30. Weymouth is in Norfolk County, so the Norfolk County Probate and Family Court in Dedham would handle the waiver request. The state's waiver guide is at mass.gov/guides/marriage-without-delay. A judge must approve it, and approval is not guaranteed. Apply right away if this is something you need.

Massachusetts Marriage License Resources

The main state guide at mass.gov/getting-married-in-massachusetts covers the full process, from filing the application to the ceremony to getting copies afterward. It is worth reading before your visit to the Weymouth Town Clerk, especially if this is your first time going through the process in Massachusetts. The guide explains what documents you need, how the waiting period works, and what happens after the officiant returns the license.

Officiants in Massachusetts include judges, justices of the peace, and ordained clergy. If you need help finding a justice of the peace, the state keeps a directory at mass.gov/info-details/justice-of-the-peace. If you want a friend or family member to officiate, the One-Day Marriage Designation allows for that. Applications go through the Secretary of the Commonwealth at the One-Day Marriage portal. The designation is for one specific ceremony only, and the application must be completed before the ceremony takes place.

The full text of Massachusetts marriage law is at MGL Chapter 207. It covers every aspect of the process, including who can marry, how the license works, waiting periods, who can officiate, and how records are kept. It is the legal framework that the Weymouth Town Clerk follows when processing applications.

After the Ceremony: Recording and Copies

When the ceremony is done, the officiant must return the signed marriage license to the Weymouth Town Clerk. This is required under MGL c. 207 § 40. The clerk records the marriage and keeps the original on file. You do not keep the license after the ceremony. The officiant handles returning it.

Once the marriage is recorded, certified copies are available from the Weymouth Town Clerk or from the state Registry of Vital Records and Statistics (RVRS). The RVRS is at 150 Mount Vernon Street in Dorchester, phone 617-740-2600. The state office has records from every Massachusetts city and town, so you can get a copy there even years later or after moving away from Weymouth. Details on requesting copies from the state are at mass.gov/how-to/request-a-marriage-certificate. Weymouth charges $15 per certified copy. Order at least two when you first request them since you will likely need them for multiple purposes over time.

Note: Weymouth also allows online ordering for certified copies. Check the town clerk's page at weymouth.ma.us for details on how to order remotely after the marriage is recorded.
